4 granted bail after arrest in PDS scandal probe

The Minister of State in charge of Government Communications, Felix Kwakye Ofosu, has disclosed that the Bureau of National Investigations (BNI) has arrested four persons linked to Power Distribution Services (PDS) over the alleged transfer of funds suspected to belong to the Electricity Company of Ghana (ECG).

In a Facebook post shared on Monday, May 4, 2026, Mr Kwakye Ofosu said the arrests were carried out last week as part of ongoing investigations into the matter. The post, captioned “Oral Update”, identified the suspects as Philip Ayensu, Viraj Phat, Sophia Korkor, and Justice Menka-Premoh.

According to the Minister, the suspects have since been granted bail pending further investigations.

The arrests form part of renewed scrutiny surrounding the management of ECG funds during the period PDS operated Ghana’s electricity distribution system. PDS assumed control of ECG on March 1, 2019, under a 20-year concession agreement backed by the Millennium Challenge Compact between the Government of Ghana and the United States Millennium Challenge Corporation (MCC).

The concession agreement was, however, terminated a few months later after government investigations uncovered that some payment guarantees, reportedly issued by a Qatar-based insurance company, were fraudulent. Subsequent court proceedings in Qatar confirmed that the guarantees had indeed been forged.

The termination of the concession led to Ghana losing approximately $190 million in MCC funding.

PDS later challenged the termination at the London Court of International Arbitration, claiming wrongful termination and seeking compensation. However, in November 2025, the arbitration court dismissed all claims, ruling that the government acted lawfully in ending the agreement because of the fraudulent guarantees.

Despite the arbitration outcome, concerns have persisted over the management of ECG revenues during the concession period. The ongoing BNI investigations are expected to shed more light on those issues.
