The office of the Attorney General and Ministry of Justice has filed an appeal to challenge the judgment the Court of Appeal that acquitted and discharged Minority Leader Dr Cassiel Ato Forson and Richard Jakpa in the ambulance trial.
The latest action follows a 2:1 majority decision of the court of Appeal on July 30, 2024 that aquitted Ato Forson and Jakpa on grounds that, the prosecution did not establish evidence against the accused persons to answer to the accusations.
In a notice of Appeal dated August 8, the AG’s office said the majority consideration of possible defences for the accused persons showed that the accused persons indeed had a case to answer and the trial court was justified in calling upon the accused to open their defence.
The AG’S office further noted that the judgment is unreasonable having regards to the evidence on record.
The office in the notice of Appeal is therfore praying the Supreme Court to set aside the decision of the Court of Appeal and order Dr Ato Forson and Richard Jakpa to continue with their defence at the High court.
